Subscription Policies for All Products (Including Throw Smart and Train Smart Apps)
Service begins as soon as your initial payment is processed. Your subscription will continue without renewal notice until you cancel. Because there’s no annual contract, your monthly rate is subject to change, but you will be notified of any change in your monthly rate with the option to cancel in accordance with these terms. Cancellations can be made any time by logging back into the Throw Smart Payment Portal using your current email and password. If you cancel the service your payment for that month, and months prior to the service being canceled are non-refundable, your service will continue until the end of that month’s billing period. We will always notify you of any change in renewal rates, beforehand.

If the applicable VAT rate (or other included tax or duty) changes during your one-year term, the tax-inclusive price will adjust accordingly. Your contract will renew automatically, on your annual renewal date, until you cancel. Should you cancel you will be charged the remaining contract obligation and your service will continue until the end of the contract period. Service begins as soon as your payment is processed. You’ll be charged the annual rate stated at the time of purchase as one lump sum, plus applicable taxes. Your contract will renew automatically, on your annual renewal date, until you cancel. Renewal rates are subject to change, but you will be notified of any change in your rate with the option to cancel in accordance with these terms. Should you cancel within the first year of your annual commitment, your payment is non-refundable and your service will continue until the end of your contracted term. In your second and subsequent years, if you cancel within 14 days following the automatic renewal, you’ll be fully refunded. Should you cancel after 14 days, your payment is non-refundable and your service will continue until the end of your contracted term. We sometimes offer free trials of our Services or other promotional offers (each a “Free
Trial”). A Free Trial provides you access to our Services for a period of time, with
details specified when you sign up for the offer.
In order to sign up for a Free Trial, you will need to provide us with your preferred
Payment Method. As soon as you submit your payment details, your Free Trial will begin.
You will not be charged until the Free Trial period ends.
Unless you cancel before the end of the Free Trial, or unless otherwise stated, your
access to the Service will automatically continue and you will be billed the applicable
fees for that Service using the Payment Method you provided. All incurred charges are
final and non-refundable. It is YOUR responsibility to know when the Free Trial will end
if you decide you do not want to become a paying Services user after the Free Trial
period.
If you decide you do not want to become a paying Services user, you must cancel your
subscription before the end of the Free Trial period. Depending on the applicable
Service, you may lose access as soon as you cancel or at the end of the Free Trial
period. Once you have cancelled your Free Trial and received confirmation, you cannot
resume the Free Trial period even if it was not used for the entire duration of the
offer.
Service features and content may change at any time, and we cannot guarantee any
specific feature or content will be available for the entire Free Trial period. The
rates in effect when you sign up for the Free Trial will be the same when the Free Trial
ends, unless we notify you otherwise. We reserve the right, in our absolute discretion,
to modify or terminate any Free Trial offer, your access to the Services during the Free
Trial, or any of these terms without notice and with no liability. You may not allow you
to sign up for more than one Free Trial of a given Service at the same time, and we
reserve the right to limit your ability to take advantage of multiple Free Trials.
Below are SOME, but not all, of the Free Trial periods/lengths we are, or have,
offer(ed). Again, the details of each free trial period/length are specified when you
sign up for the offer. As previously stated, it is YOUR responsibility to know when the
Free Trial will end.

If you cancel the service anytime after the beginning of the billing cycle, your payment for that month, and months prior to the service being canceled are non-refundable, regardless of whether or not you actively use the Service, and your service will continue until the end of that month’s billing period. We will always notify you of any change in renewal rates, beforehand.
If you do not pay the fees or charges due for your use of the Services, we may make reasonable efforts to notify you and resolve the issue; however, we reserve the right to disable or terminate your access to the Services (and may do so without notice).
You can cancel the Services at any time, however in accordance with the Service plan/option you signed up for, and it's corresponding commitment terms, you may be responsible for additional charges accordingly. Cancellations can be made by logging back into the Throw Smart Payment Portal using your current email and password. If you have any questions or need any assistance please contact Customer Support. Once you have cancelled your Service and received confirmation, no other changes will be made to your account. The cancellation of a Service will go into effect at the end of your current billing cycle, and you will have the same level of access to the Service through the remainder of such billing cycle. For example, if you are billed on a monthly basis and cancel during a given month, you will be charged for the entirety of that month and maintain access to the Service through the end of that month.
There are no refunds for termination or cancellation of your Service. If you no longer wish to subscribe to a Service, it is your responsibility to cancel your Service in due time, regardless of whether or not you actively use the Service.
Our pricing and payment options are available at https://payments.throwsmart.com/register. If you agree to a subscription price, that will remain your price for the duration of the payment term; however, prices are subject to change at the end of a payment term.
By agreeing to these Terms, you are giving us permission to charge your on-file credit card, PayPal account, or other approved methods of payment for fees that you authorize for Throw Smart, LLC.
Responsibility for Payment
You are responsible for all fees, including taxes, associated with your use of the Service. By using the Service, you agree to pay Throw Smart, LLC any charge incurred in connection with your use of the Service. If you dispute the matter, contact Customer Support. You are responsible for providing us with a valid means of payment for paid Accounts.
The following Terms of Service and Conditions apply to All Products (Including Throw Smart and Train Smart Apps as well as any equipment purchased or received from Throw Smart, LLC). The participant – or participant's legal guardian – understands and agrees to the terms of this agreement.
I recognize and acknowledge that there are risks of serious physical and other injuries associated with me or my child’s attendance or participation in the Throw Smart, LLC's services. There are severe social and economic losses which might result not only from a participant’s own actions but also from the actions, in actions, or negligence of others, or the condition of the premises or equipment used and, nevertheless, I agree to assume full risk of any injury, damage, or loss regardless of severity that I or my child may sustain as a result of attending and/or participation in Throw Smart, LLC's services.
Accordingly, I agree to waive, relinquish, discharge, release, and covenant not to sue Throw Smart, LLC, or its parent, sister affiliated and/or subsidiary corporations and related entities, their members, owners, officers, directors, partners, employees, consultants, contractors, advisors, agents, insurers, attorneys and volunteers, from any and all rights, claims of injury, demands, causes of action, damages, liabilities or loss that I or my child may have or that may accrue to me or my child arising out of, connected with, or in anyway associated with me or my minor child’s attendance at or participation in Throw Smart, LLC's services. Notwithstanding the foregoing and any other provision of this Agreement, I do not waive any rights that I may have to seek redress due to the reckless or intentional conduct of any individual or entity.
I further agree to release, indemnify and hold harmless Throw Smart, LLC, its members, directors, officers, employees, affiliates, parents, and subsidiaries, from any and all manner of claims, causes of action or liability that may arise directly or indirectly from me or my minor/ward’s attendance at or participation in the Throw Smart, LLC's services, including but not limited to, injuries to an individual or damage to property caused by such attendance or participation. I am aware this program has high levels of strenuous activity and will participate at the level that my body will allow. It will be my responsibility to inform Throw Smart, LLC and its members as to my general health prior to participating in the program. I will also inform Throw Smart, LLC of any previous injuries or illness that may be aggravated by such strenuous activity. If I or my child sustains an injury, not limited to the Throw Smart, LLC's services I will make the members of Throw Smart, LLC aware of the injury and will only continue with the Throw Smart, LLC's services as directed.
Furthermore, I understand that the Children's Online Privacy Protection Act ("COPPA") prohibits online service providers from knowingly collecting personally identifiable information from children under thirteen (13) years of age without verifiable parental consent ("Consent"). Thus, I understand in the case I am purchasing the Throw Smart, LLC's services for my child who is under thirteen (13) years of age, as his/her parent or guardian, I give consent to Throw Smart, LLC to collect my child's information that is necessary for them to fulfill recommendations, training and other services that I am agreeing to and making payment for at this time. I acknowledge that as the individual making payment for this child's participation in Throw Smart, LLC's services, I have the legal right and legal authority to give such consent as is necessary.
I have read this Agreement thoroughly and fully understand it. I enter into it voluntarily on behalf or myself, my spouse, my heirs, next of kin, personal representatives, related individuals and related entities. No one has made me any representations, statements or inducements that change or modify anything written in this Agreement.
